1. Provider and scope
These terms govern the use of Fällig and paid Fällig Pro services provided by MS Software, Marcel Steiner, Hügelweg 1, 9400 Wolfsberg, Österreich (“Provider”). Mandatory consumer protection law remains unaffected.
2. Fällig service
Fällig is a web application that helps users organise reminders for dates, subscriptions, returns, warranties, contracts, invoices and similar matters. Users decide which information and dates they enter. Fällig is an organisational aid and does not provide legal, tax or financial advice.
3. Account and user obligations
Users must provide a valid email address, protect their access credentials and keep entered information accurate. The service must not be used unlawfully, abusively, to impair security or to infringe third-party rights.
4. Free and Pro
The Free plan currently permits up to three active reminders. Fällig Pro includes the features shown in the current plan overview, including higher or unlimited reminder limits and additional Pro tools. We may further develop features; paid core functionality will not be materially reduced during a paid billing period without a valid reason.
5. Price, contract and payment
Fällig Pro currently costs €4.99 per month and is billed in EUR. For consumers, the total amount payable is shown before the order is submitted. Tax treatment depends on the customer location and applicable law. The Provider currently intends to use the Austrian small-business VAT exemption where its requirements are met; this does not override tax obligations that may apply to cross-border supplies. The subscription is recurring and payment is processed by our payment provider. The paid contract is concluded when the payment process is successfully completed and Pro access is activated.
6. Term and cancellation
The Pro subscription runs monthly and renews automatically for further monthly periods unless cancelled. It can be cancelled through the account/subscription management function. Unless the cancellation flow explicitly states otherwise, cancellation takes effect at the end of the already paid billing period and Pro access remains available until then.
7. Consumer withdrawal rights
Consumers generally have a statutory 14-day right to withdraw from a distance contract, starting on the day the service contract is concluded. Details and a model withdrawal notice are available on the Withdrawal page. If you expressly request that Pro service starts before the withdrawal period ends, we may begin performance immediately. If you then withdraw within the statutory period, a proportionate amount may be payable for services already provided where the legal requirements are met. Mandatory local consumer rights remain unaffected.
8. Reminder delivery and responsibility
We operate the reminder functions with reasonable technical care. Email delivery and availability can nevertheless be affected by internet connections, email providers, spam filters, maintenance or third-party services. Users should therefore not rely on Fällig as their sole means of monitoring statutory, court, contractual or other critical deadlines. This does not limit mandatory statutory rights or liability that cannot legally be excluded.
9. Availability and maintenance
We aim for reliable availability but do not promise uninterrupted operation. Planned maintenance, security measures and incidents may temporarily restrict access. We will remedy material faults within a reasonable period where this is within our control.
10. Liability
Liability is governed by mandatory law. Nothing in these terms excludes liability for death or personal injury, intentional misconduct, gross negligence or any liability that cannot lawfully be limited. For consumers, statutory warranty and digital-service rights remain unaffected.
11. Account termination and deletion
Users may delete their account using the account function. An active paid subscription should be cancelled beforehand. Data may continue to be retained where required by tax, accounting or other mandatory law or where necessary for legal claims.
12. Changes to these terms and prices
We may update these terms for valid reasons such as changes in law, security, technology or service functionality. Material changes affecting an ongoing paid subscription will be communicated in a reasonable and transparent manner. Price changes apply only prospectively and are communicated before they take effect; mandatory termination or objection rights remain unaffected.
13. Governing law and international customers
The service is offered worldwide where legally and technically available to both consumers and business customers. Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice does not deprive them of mandatory protections granted by the law that would apply without this choice, in particular the law of their habitual residence where applicable. Mandatory rules on consumer jurisdiction also remain unaffected. Business customers must provide accurate company and tax information where required. For business customers, the courts at the Provider's place of business in Austria are agreed as the exclusive venue to the extent legally permitted.
